1. Who operates the offer
The Fitterly Founder 100 offer is operated by SmitSocial.Media Limited, a company registered in England and Wales under company number 10441282. Its registered office is Ferndown, Queens Avenue, Maidstone, United Kingdom, ME16 0ER.
Questions may be sent to hello@fitterly.app.
2. The Founder 100 offer
Fitterly is inviting up to 100 health, fitness and wellbeing businesses and professionals to form its first paid founding cohort. An activated Founder place includes:
- early access when the relevant professional plan becomes available;
- a 50% Founder discount on the then-current regular recurring fee for an eligible Fitterly base plan; and
- opportunities to provide product feedback.
An application records interest only. It is not an account reservation, discount entitlement or guarantee of an invitation.
3. Eligibility
Applicants must be at least 18, use Fitterly for a genuine professional or business purpose, provide accurate contact details and comply with applicable professional, consumer, advertising and data-protection laws. The offer is limited to one Founder place per person or business unless Fitterly agrees otherwise in writing.
Fitterly may reject automated, fraudulent, duplicate, abusive or materially inaccurate applications and applications that do not relate to an intended Fitterly professional use.
4. How the first 100 places are allocated
An applicant must confirm ownership of the submitted email address using Fitterly's secure verification link. Eligible verified applications join the queue in the order their verification is completed. Duplicate applications do not create additional positions. Honeypot submissions and applications reasonably identified as spam, fraud, abuse or ineligible professional use are excluded.
When paid Founder activation opens, Fitterly may invite eligible applicants in queue order. Each invitation states an exact expiry date 30 days after it is sent. If the applicant does not complete paid activation before that deadline, the offer expires and the available opportunity may be offered to the next eligible applicant, who receives their own 30-day window.
A Founder number is assigned only after successful activation of an eligible paid subscription. The campaign closes when 100 Founder subscriptions have been activated. A later cancellation by an activated Founder does not require Fitterly to reopen the campaign.
5. What the continuing 50% discount means
The Founder discount is 50% off the then-current standard recurring price of an eligible Fitterly base subscription. It is not a permanently frozen monetary price. If standard pricing changes, the qualifying Founder price remains 50% of the applicable standard base-plan price.
The discount continues for the uninterrupted life of that qualifying paid Founder subscription and while Fitterly offers an equivalent paid core service. It:
- belongs to the activated Founder organisation and cannot be sold or transferred to a different account or organisation;
- continues when the organisation moves between eligible paid base plans;
- does not apply to taxes, payment-processing charges, optional add-ons, usage charges, AI credits or overages, extra practitioner seats, marketplace promotion, third-party costs or separately priced services unless Fitterly expressly states otherwise;
- cannot normally be combined with another discount; and
- does not have a cash value.
6. Activation and payment
Fitterly will send any activation invitation to the verified application email. The applicant must use the secure invitation, complete account and organisation setup, accept the current service terms and Founder activation terms, select an eligible paid base plan and provide a valid payment method before the stated 30-day deadline.
The price, billing frequency, recurring nature of the subscription, plan limits and Founder discount will be shown before payment is authorised. Selecting the free plan or merely creating an account does not activate a Founder place. Acceptance of the current activation terms is recorded separately from acceptance of the earlier application terms.
7. Founder participation and feedback
Feedback is welcome but not mandatory unless a specific research session says otherwise. A Founder grants Fitterly permission to use suggestions and general feedback to improve the product without payment or attribution. This does not transfer ownership of the Founder's pre-existing materials, brand or confidential client information.
Founders must not share private test credentials, confidential pre-release materials or another person's personal or health information without authority.
8. Product development and availability
Fitterly is in development. Features, dates, designs and availability may change, and early versions may contain faults or interruptions. Public website descriptions communicate product direction and do not guarantee that every feature will be available at activation.
Fitterly is business and coaching software, not a medical service, emergency service or substitute for professional judgement.
9. Ending Founder access
A Founder may cancel according to the applicable subscription terms. The Founder discount ends when the qualifying subscription is voluntarily cancelled, downgraded to the free plan, transferred to another organisation, or terminated for fraud, abuse or serious breach. A failed payment receives the payment-recovery period stated at checkout, expected to be 14 days; the discount continues if the payment is successfully recovered within that period.
If the subscription remains unpaid beyond the recovery period, the Founder entitlement lapses and is not automatically restored. If Fitterly permanently discontinues the relevant service, the discount ends with that service. It cannot be converted into cash or applied to an unrelated product.
10. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence. Subject to that, SmitSocial.Media Limited is not responsible for indirect or consequential loss arising solely from an application, an unconfirmed place or changes to a pre-release product.
11. Privacy and communications
Application details are handled as described in the Fitterly Privacy Notice. Applicants agree to receive service messages needed to process the application, confirm eligibility, invite activation and communicate relevant early-access information. Applicants can withdraw before activation by emailing privacy@fitterly.app.
12. Governing law, changes and contact
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory rights that apply where an applicant lives.
Fitterly may update these terms for future applications. The application and activation versions accepted are recorded. Because version 2.0 materially changes the allocation process, applicants who previously accepted an earlier version must accept the current activation terms before securing a paid Founder place.
